Terms of Service

The agreement covering the client site builder and the 10DLC packet workspace.

1. This agreement

These terms are a binding agreement between OneMoreSend (“OneMoreSend”, “we”, “us”) and the business that uses the Site Builder (“Client”, “you”). Whoever accepts them confirms they are at least 18 and authorized to bind that business. If you do not agree, do not use the Site Builder.

The Privacy Policy and the Data Processing Addendum form part of this agreement.

2. What the service does

The Site Builder collects a Client’s business information, generates a website, publishes it on a OneMoreSend-controlled subdomain, and prepares the brand and campaign fields a carrier or Telnyx asks for. It also stores documents the Client chooses to upload.

We provide software and a publishing surface. We are not the Client’s lawyer, carrier, messaging provider, or registration agent unless we separately agree in writing.

3. The Client is responsible for accuracy

The Client is responsible for every fact it enters: legal name, EIN, entity type, address, phone, email, website, authorized contact, services, licenses, and messaging content. These must match the Client’s IRS records, state filing, and actual operations.

If a brand is rejected because the legal name, EIN, or address does not match public records, that is the Client’s responsibility. The Client should use its CP 575 or 147C letter as the source of truth.

4. No guarantee of registration

Telnyx, The Campaign Registry, mobile carriers, and their vetting partners decide whether a brand or campaign is approved. Their decisions are outside our control. We do not promise approval, a particular trust score, throughput, delivery, or that a generated site will pass every review. We prepare the packet to their published requirements; the reviewer decides.

5. The Client’s site and content

The Client grants us the right to host, render, and publish the content and images it provides, and to use them to operate the Site Builder. The Client confirms it owns or has permission to use every logo, photo, review, and text it uploads.

A generated site is a draft. The Client must review the copy, services, policies, and contact details before publishing. Placeholder reviews and stock photos should be replaced. The Client’s published site must carry its own privacy policy, terms, and SMS terms; the generated versions are drafts, not legal advice.

6. Messaging and consent

The Client is the sender of its messages. The Client is responsible for prior express written consent, one-to-one opt-in, honoring STOP and HELP, quiet hours, content, and every applicable law and carrier rule. Purchased, rented, scraped, or appended lists are prohibited. The Client must keep evidence of consent.

7. Uploaded documents

EIN letters, formation documents, licenses, and proof-of-address documents are stored privately and used only to prepare or support the Client’s registration. The Client should redact unrelated information before uploading. The Client can ask us to delete a document at any time.

8. Account and access

Keep credentials private and tell us promptly if they are compromised. The Client is responsible for everything done under its account, including by staff, contractors, or an agency acting for it.

9. Acceptable use

The Client may not use the Site Builder for unlawful, deceptive, or prohibited content; to impersonate another business; to publish a site that misrepresents the business; to upload malware; or to interfere with the service. We may suspend or remove a site that breaches these terms or draws a carrier or regulator complaint.

10. Fees

Fees are those quoted to the Client in writing or shown at checkout, charged in advance. Unless a written quote says otherwise, fees are non-refundable for a period already begun. Carrier, registry, and Telnyx pass-through charges are the Client’s responsibility.

11. Intellectual property

We own the Site Builder, its templates, and its software. The Client owns its business content and uploaded assets. The Client’s generated site may use our templates; the Client’s right to use them ends if the account closes, though a published copy may remain live for as long as we host it.

12. Disclaimers

To the fullest extent the law allows, the Site Builder is provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted service, error-free rendering, or that a carrier will accept a registration.

13. Indemnity

The Client will defend and indemnify OneMoreSend against claims, losses, fines, and reasonable legal fees arising from its business, its site content, its messages, its consent practices, or its breach of these terms.

14. Limitation of liability

To the fullest extent the law allows, OneMoreSend is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for a claim relating to the Site Builder is limited to the greater of the fees the Client paid us in the twelve months before the claim or one hundred US dollars.

15. Disputes

Before starting a proceeding, the party with a complaint will send a written description and the parties will try in good faith to resolve it for thirty days. Any unresolved dispute will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, seated in the State of Florida. Claims may be brought only individually, not as a class action. Either party may seek urgent injunctive relief in court.

16. Changes and contact

We may update these terms and will post the new date here. Material changes will be announced to account holders before they take effect. Questions: hello@onemoresend.com.
